Die Strukturzulage Bayern ist eine unwiderrufliche, das Grundgehalt ergänzende Zulage für Beamte und Beamtinnen bestimmter Besoldungsgruppen. Sie ist in Art. 33 des Bayerischen Besoldungsgesetzes (BayBesG) geregelt, die Höhe ergibt sich aus Anlage 4 BayBesG. Aktuell beträgt sie 111,85 Euro monatlich für die meisten Berechtigten. Dieser Ratgeber liefert in der jeweiligen Fassung Definition, Anspruch, Höhe, Voraussetzungen und Abgrenzung zu anderen Zulagen.
Was ist die Strukturzulage in Bayern?
Die Strukturzulage ist ein fester monatlicher Betrag, der bestimmten Beamten zusätzlich zum Grundgehalt gezahlt wird. Sie soll die Besoldungsstruktur zwischen Eingangsämtern und Beförderungsämtern stützen. Sie wird unwiderruflich gewährt, das heißt, ein einmaliger Anspruch entfällt nicht durch nachträgliche Maßnahmen. Sie wird entsprechend dem Grundgehalt nach Maßgabe von Art. 16 BayBesG bei allgemeinen Anpassungen erhöht.
Zweck und Ziel
Sie gleicht historische Verwerfungen im Besoldungsgefüge aus. Mit ihr werden Beamte in mittleren bis höheren Stufen der A-Besoldung gleichmäßig finanziell gestärkt, um die Attraktivität des öffentlichen Dienstes zu sichern.
Historie
Die Strukturzulage existiert in Bayern bereits seit der Föderalismusreform und ist seit Inkrafttreten des BayBesG am 1. Januar 2011 fest in dessen Stand verankert.
Rechtsgrundlage
Maßgeblich sind Art. 33 BayBesG und Anlage 4 BayBesG. Der Volltext steht in den Druck-Ausgaben und als PDF auf gesetze-bayern.de und auf der Seite des Landesamts für Finanzen (lff.bayern.de) bereit.
Anspruch und Anspruchsberechtigte
Anspruch haben nach Art. 33 Satz 1 BayBesG Beamte und Beamtinnen der Besoldungsgruppen A 9 bis einschließlich A 13 sowie Beamte und Beamtinnen im Polizeivollzugsdienst in der Besoldungsgruppe A 5. Typische Berufsgruppen: allgemeine Verwaltung, Justiz, Steuerverwaltung, Polizei (Anwärter und Eingangsamt A 5). Ausnahme nach Satz 2: keine Strukturzulage für Fachlehrer und Fachlehrerinnen ab Besoldungsgruppe A 10, Lehrer und Lehrerinnen ab Besoldungsgruppe A 12 sowie Studienrätinnen und Studienräte im Grundschuldienst, Mittelschuldienst, Förderschuldienst oder Realschuldienst ab Besoldungsgruppe A 13.
Voraussetzungen
Folgende Voraussetzungen müssen erfüllt sein: aktives Beamtenverhältnis im Geltungsbereich BayBesG, eine der genannten Besoldungsgruppen, kein Ausschluss nach Satz 2 (Lehrer-Ausnahme). Anwärter in der Ausbildung erhalten die Zulage in der Regel noch nicht. Bei Teilzeit wird die Strukturzulage nach Art. 6 BayBesG anteilig (pro rata) gekürzt.

Stand laut Anlage 4 BayBesG in der aktuellen Fassung. Bei Treffer einer allgemeinen Erhöhung des Grundgehalts steigt auch die Strukturzulage entsprechend Art. 16 BayBesG mit.
Antrag und Auszahlung
Es ist kein Antrag erforderlich. Die Strukturzulage wird automatisch durch das Landesamt für Finanzen mit den monatlichen Bezügen ausgezahlt. Bei Statusänderungen (Beförderung, Wechsel der Besoldungsgruppe) erfolgt eine automatische Anpassung.

Regionen
Die Strukturzulage gilt bayernweit einheitlich, unabhängig vom Landkreis. Anders die Ballungsraumzulage, die nur in bestimmten Regionen (München, Garching, Erlangen u.a.) gezahlt wird.
Beispielrechnung
Beamtin in Besoldungsgruppe A 11, Stufe 5: Grundgehalt rund 4.300 €, Strukturzulage 111,85 €, ggf. Familienzuschlag. Gesamtbrutto rund 4.412 €. Brutto erhöht sich um die Strukturzulage, Netto je nach Steuerklasse und Beiträgen.
